Child custody is one of the most emotionally charged issues in a divorce. In Pennsylvania, the court will make a decision on child custody based on the best interests of the child, taking into account factors such as the child's relationship with each parent, the child's educational and health needs, and each parent's ability to provide a stable and nurturing environment.


There are two types of custody in Pennsylvania: physical custody and legal custody. 


Physical custody: refers to where the child will live

Legal custody: refers to the right to make decisions about the child's upbringing, such as medical treatment, education, and religion.


In Pennsylvania, custody can be either joint or sole. 

Joint custody: means that both parents share physical and/or legal custody of the child.

Sole custody: means that only one parent has physical and/or legal custody of the child.


The court may also award shared physical custody, in which the child spends equal or nearly equal time with each parent. In this case, a parenting plan must be developed that sets out the details of the shared custody arrangement, including the schedule for visits and holidays.
